American Conference Institute Upcoming Events
Corporate executives, as well as their legal and business advisors, today need more information than ever to gain or maintain a competitive advantage.
For 20 years, ACI conferences, summits, and executive briefings have provided the business intelligence that decision makers need to react decisively and effectively to challenges and opportunities in the marketplace.
Global Patent Litigation Congress
October 7th, 2008 – October 8th, 2008
This is the ONE place where you will learn how to develop a multi-jurisdictional patent litigation management strategy – from deciding where
to litigate to obtaining adequate damages – and every step in between.
Multi-jurisdictional patent litigation has become increasingly common given the number of companies who find it easier and more cost effective to patent, manufacture and distribute goods overseas. With these endeavors, come massive challenges due to the unknown characteristics relevant to other countries’ legal and business systems. One of the biggest hurdles is developing a multi-jurisdictional strategy that must be executed and managed in a cost-effective, practical and logistical manner.
American Conference Institute’s Global Patent Litigation Congress begins with a detailed analysis of the decisions that must be made at the enforcement stage and then delves into the strategic processes that determine where patents will be filed. Our panelists will further explain how to determine the likelihood of enforcement and ultimately the success of litigation, depending on the jurisdiction and its reputation for receiving the specific type of patent. A unique group of practitioners with global experience from top law firms and companies will guide you through the entire process of managing patent litigation on a global scale. Specific highlights of this invaluable conference include:
- Examining jurisdictional factors to determine where to file patents
- Understanding different countries’ requirements for filing to ensure that your rights will be enforced
- Incorporating the cost of litigation into the corporate budget plan
- Building relationships with local counsel and international contacts to enhance the success of litigation
- Devising strategies for litigating in the EU based on judicial practices, efficiency, and laws in the different countries
- Assisting foreign companies with navigating the litigation landscape in the U.S.
- Balancing the decision to litigate in China against the multiple risks and likelihood to obtain adequate damages
- Deciding whether to opt for arbitration or another litigation alternative
This is your opportunity to meet with fellow practitioners with extensive experience litigating patent claims overseas. Share strategies with other in-house and outside counsel in your field on all practices relevant to global patent litigation. You will acquire additional knowledge about jurisdictions in which you will undoubtedly find yourself litigating in the near future.
To complement your overall experience, be sure to register for our pre-conference workshop, Developing a Multi-Country Approach for Patent Enforcement, Litigation Management, and Execution. Through a series of detailed hypotheticals, the workshop leaders will map out a plenary strategic litigation plan focusing specifically on major jurisdictions and highlighting the tools that are necessary to accomplish your goals overseas.

Anti - Corruption in Russia & The CIS
November 11th, 2008 – November 12th, 2008
Problems of corruption in Russia and the CIS for foreign investors have increased dramatically in the last several years. Allegations of bribes required by government officials directly and through intermediary companies are rampant.
This conference will demonstrate how business can be done in Russia and the other countries in the CIS without violating FCPA, anti-corruption and related legislation. The speakers will be experienced in structuring transactions, implementing compliance procedures and developing appropriate oversight mechanisms to minimize the risk of corrupt payments.
This one-of-a-kind conference is comprehensive, topical and timely for all companies operating or investing in Russia and the CIS, and their advisers. Attendees will get an update on the anti-bribery landscape in Russia, the intersection of the FCPA and local anti-bribery laws and how to develop and monitor effective internal controls and compliance programs. Topics will include:
- Evaluating the compliance of CIS subsidiaries, branches and offices with applicable anti-corruption laws and detecting potential problems
- Understanding the criteria for the selection of intermediaries in light of the particular due diligence challenges of the CIS markets
- Explaining local anti-corruption legislation and its enforcement
- Addressing the cultural problems in these countries which undermine compliance initiatives
- Discussing the problems of compliance that arise in the acquisition of companies in the CIS
- Understanding how to develop, implement and oversee effective compliance policies in the CIS countries
Foreign Corrupt Practices Act
November 17th, 2008 – November 20th, 2008
CELEBRATE THE 20TH ANNIVERSARY OF ACI’s FLAGSHIP FCPA CONFERENCE
Vigorous enforcement of the Foreign Corrupt Practices Act continues to be a priority for the US Department of Justice and the US Securities and Exchange Commission, across industries and around the globe.
The past 12 months produced the largest number of FCPA cases, the largest criminal fine to date ($26 million) and the largest combined sanction ever imposed for violations of the FCPA ($44 million).Recent settlements have resulted in heavy civil and criminal penalties for both individuals and corporate offenders, disgorgement of profits and, increasingly, the imposition of independent monitors. Foreign governments, primarily in Europe, are also cracking down on corruption and actively cooperating with US enforcement officials.
The increase of FCPA enforcement makes prevention an even higher priority than it may have been in the past. The absence of preventative measure is almost certain to result in substantially increased penalties if an issue arises. This makes an effective anti-corruption compliance program essential for all companies. With record-setting sanctions involving well-known companies, global organizations have to reassess their own anti-corruption measures to prevent lapses that might lead to damaging and costly enforcement actions.
Now in its 20th successful year, the American Conference Institute's National Conference on the FOREIGN CORRUPT PRACTICES ACT is the event that corporate counsel, compliance officers, outside counsel and consultants rely on for comprehensive, insightful, and practical guidance on critical FCPA compliance issues. Benefit from the practical perspective of seasoned corporate FCPA compliance executives, get an update on enforcement and policy initiatives from top Government officials and FCPA attorneys, and learn how industry is setting up internal controls to comply in this constantly changing global legal landscape. This year’s agenda will include the latest information on:
- Changes you need to make to your compliance program as a result of recent cases against companies and individuals
- How government agencies evaluate voluntary disclosures
- The FCPA’s definition of facilitating payments: when grease becomes a bribe
- Deciding whether you've investigated “enough”: how much is enough in trying to learn the facts?
- Risks and concerns when a joint-venture partner is a governmental entity
- What your system of fraud risk internal controls needs to accomplish
- Communicating with government authorities: balancing cooperation with maintaining an effective defense
The last conference in DC was the largest turnout ever for this conference. Be sure to register early by calling 1-888-224-2480, by faxing your registration form to 1-877-927-1563 or by registering online at www.AmericanConference.com/FCPA.
